Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Floreer website and services operated by Floreer Local Goodness (Pty) Ltd ("Floreer", "we", "us"). By using our website, creating an account, or placing an order, you agree to these Terms. If you do not agree, please don't use our services.

1. Definitions

"Member" means a customer with an active premium membership; "Goods" means products offered for sale; "Order" means a request to purchase Goods; "Delivery Area" means the Garden Route region we serve, from Glentana to Knoetzie.

2. Eligibility & your account

You must be at least 18 years old and able to enter into a binding contract. You're responsible for keeping your account details accurate and your login secure, and for all activity under your account.

3. Products, availability & pricing

We sell carefully curated, seasonal local food, so availability can change and some items may sell out. Prices are shown in South African Rand and [include / exclude] VAT where applicable. We try to keep all information accurate, but may correct errors in pricing or descriptions before accepting your order.

4. Orders & acceptance

Placing an order is an offer to buy. A contract is formed only when we confirm acceptance of your order. We may decline or cancel an order — for example if Goods are unavailable, an error occurred, or delivery falls outside the Delivery Area — and will refund any amount already paid.

5. Payment

Payment is processed securely through our payment provider, [PayFast]. We do not store your full card details. Orders must be paid in full before delivery unless we agree otherwise in writing. Recurring membership payments are governed by section 7.

6. Delivery

We deliver within the Delivery Area, with free delivery for members within [80 km]. We'll give an estimated delivery window, but times are not guaranteed and may be affected by weather, stock, or circumstances beyond our control. Risk in the Goods passes to you on delivery; please ensure someone can receive perishable items.

7. Premium membership

Membership gives access to benefits such as free local delivery and member pricing for a fee of [R249] per [period]. Membership [renews automatically / must be renewed] until cancelled. You may cancel at any time, effective at the end of the current paid period; refunds (if any) are dealt with in our Refund & Returns Policy. We may change membership benefits or fees on reasonable notice.

8. Returns & refunds

Returns, replacements, and refunds — including how we handle fresh and perishable goods — are governed by our Refund & Returns Policy, which forms part of these Terms.

9. Your responsibilities

You agree to use our website lawfully and not to interfere with its operation, attempt unauthorised access, or use it to transmit harmful or unlawful content. We may suspend or close accounts that breach these Terms.

10. Intellectual property

All content on this website — including text, images, logos, and branding — is owned by or licensed to Floreer and protected by law. You may not copy, reproduce, or use it without our prior written permission.

11. Limitation of liability

To the maximum extent permitted by law, and without limiting your rights under the Consumer Protection Act, Floreer is not liable for indirect or consequential loss, and our total liability for any claim is limited to the value of the relevant Order. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify Floreer against reasonable claims, losses, and costs arising from your breach of these Terms or your misuse of our services.

13. Privacy

We process your personal information in line with our Privacy Policy, which forms part of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be on this page, with the effective date shown above. Continuing to use our services after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa, and you agree to the jurisdiction of its courts [Western Cape].
